1.4. The Seller (or a natural person connected with the operator) is the owner of the US trade mark registered with the United States Patent and Trademark Office (USPTO) under Registration No. 6166384 for alcoholic beverages under International Class 033. The graphical representation of the brand, logos, texts, and all content of the Swiss Wine™ e-shop are protected by trade mark and copyright laws. Any unauthorized use without the prior written consent of the owner is prohibited.

2. Who These Terms Apply To

2.1. These Terms apply to orders placed through our website by customers located in the United States, subject to product availability, delivery availability, and legal shipping restrictions.

2.2. Certain products, especially alcoholic beverages, may not be available for shipment to all U.S. states, territories, or local jurisdictions.

2.3. By placing an order, you confirm that delivery of the ordered goods to your address is lawful and permitted under applicable state and local law.

3. Age Restriction

• we cannot complete age verification or shipping compliance requirements; or shipment to the requested address is not available or legally permitted.

5.4. If we cancel an order after payment has been taken, we will refund you in accordance with these Terms.

6.2. The final amount payable by you will be shown at checkout before you place your order.

• Bitcoin or Satoshis;

• Lightning Network;

• PayPal;

• credit or debit card; or

• any other payment method displayed at checkout.

7.2. Payment must be successfully authorized before shipment.

8. Cryptocurrency Payments

8.1. If you choose to pay in Bitcoin or Satoshis, you acknowledge that cryptocurrency values are volatile.

8.2. For a standard discretionary return accepted under our return policy, any refund may be made in the same amount of Satoshis originally received by us, unless we agree otherwise or applicable law requires a different outcome.

8.3. Nothing in this clause limits any rights you may have under applicable law in relation to faulty, damaged, misdescribed, or non-delivered goods.

8.4. Where applicable law requires a refund by reference to the USD purchase price, we will comply with that law.

9. Shipping and Delivery

9.1. We ship to selected U.S. states and destinations only.

9.2. Estimated delivery times are provided for information only and are not guaranteed.

9.3. We will deliver to the shipping address provided in your order confirmation.

9.4. Risk of loss or damage to goods passes to you when the goods are delivered to the delivery address, to the extent permitted by applicable law.

9.5. If delivery cannot be completed because age verification fails, the recipient refuses delivery without lawful reason, the address is incorrect or incomplete, or the recipient repeatedly fails to accept delivery, we may charge you for reasonable redelivery or return costs where permitted by law.

10. Title to Goods

10.1. Title to the goods passes to you only when:

• we have received payment in full; and

• the goods have been delivered to you.

12. Damaged, Defective, or Incorrect Goods

• photographs of the packaging and goods, where available.

12.3. Where required by applicable law, we will provide an appropriate remedy, which may include replacement, refund, or other remedy required by law.

13.1. We may cancel a contract and refund you if:

• we are unable to ship for legal or operational reasons;

• we reasonably suspect fraud or misuse;

• age verification requirements cannot be met; or

• there is an obvious pricing or listing error.

14. Promotions, Discounts, and Vouchers

14.1. Promotions, discount codes, and vouchers are subject to any additional terms stated with the relevant offer.

14.2. Unless expressly stated otherwise:

• promotions cannot be combined;

• vouchers have no cash value; and

21.4. Class Action Waiver: YOU AND SWISS WINE s.r.o. AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

22.2. The version published on the website at the time you place your order will apply to your contract.
